Terms of Service

1. Acceptance of These Terms

These Terms of Service (Terms) are a legal agreement between you and Co-Exist Australia Ltd (ABN 39 660 776 983), a registered Australian charity (Co-Exist, we, us, our). They govern your access to and use of the Co-Exist mobile app, website, and related services (together, the Service).

By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

2. Eligibility

The Service is intended for people aged 18 and over. By using the Service you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organisation or collective, you confirm that you are authorised to bind that entity to these Terms.

3. About Co-Exist and the Service

Co-Exist is a youth-led conservation community that connects young people with environmental action across Australia. The Service lets you discover and register for conservation events, join collectives, communicate with other members, log conservation impact, make donations, and purchase merchandise. We may add, change, or remove features of the Service at any time.

4. Your Account

  • You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
  • You must provide accurate account information and keep it up to date.
  • You must notify us promptly at hello@coexistaus.org if you suspect any unauthorised use of your account.
  • You may not share, sell, or transfer your account, or let another person use it.

5. Licence to Use Co-Exist

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial participation in the Co-Exist community. This licence ends automatically if you stop using the Service or if your account is terminated. You must not use the Service for any purpose that is not expressly permitted by these Terms.

6. Our Intellectual Property

The Service, including its software, source code, design, branding, logos, text, graphics, and all other materials we provide (excluding user-generated content), is owned by or licensed to Co-Exist and is protected by Australian and international intellectual property laws. Except as these Terms allow, you must not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Service without our prior written consent. The Co-Exist name and logo are our trade marks and may not be used without our permission.

7. User-Generated Content

Co-Exist allows users to share messages, photos, and other content within the app (User Content). You retain ownership of your User Content. By posting it, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and distribute that content solely to operate, promote, and improve the Service. You are solely responsible for your User Content and confirm that you have all rights necessary to post it and that it does not infringe the rights of any other person.

Zero Tolerance for Objectionable Content

Co-Exist has zero tolerance for objectionable content or abusive users. The following content is strictly prohibited:

  • Content that is offensive, abusive, threatening, or harassing
  • Hate speech, discrimination, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Sexually explicit or pornographic content
  • Content depicting or promoting violence
  • Spam, scams, or misleading content
  • Content that infringes on intellectual property rights
  • Content that promotes illegal activities

Content Moderation

All user-generated content is subject to moderation. Co-Exist employs both automated systems and human review to identify and remove objectionable content. Content may be filtered or removed without notice.

Reporting and Blocking

Users can report objectionable content and block abusive users at any time using the in-app reporting and blocking features. Reported content is reviewed by our moderation team within 24 hours.

Enforcement

Users who violate these guidelines will face consequences including but not limited to:

  • Immediate removal of the offending content
  • Temporary or permanent suspension of the user account
  • Reporting to relevant authorities where required by law

The developer acts on objectionable content reports within 24 hours by removing the content and ejecting the user who provided the offending content.

8. Acceptable Use

When using the Service you must not:

  • Break any applicable law, or encourage or help anyone else to do so.
  • Impersonate any person or misrepresent your affiliation with any person or organisation.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Service, our systems, or other users' accounts.
  • Introduce viruses, malware, or any other harmful code.
  • Scrape, harvest, or collect data about other users without their consent.
  • Use the Service to send unsolicited marketing, spam, or bulk messages.
  • Use the Service to harass, intimidate, or endanger the safety of any person.

9. Events and In-Person Activities

Conservation events and volunteering listed through the Service often take place outdoors and may involve physical activity and inherent risks. Events may be organised by Co-Exist, by member collectives, or by third parties. To the extent permitted by law, you take part in any event at your own risk and are responsible for assessing your own fitness and safety. You must follow the reasonable directions of event organisers and any applicable safety requirements. We do not warrant that any event will proceed as described, and event details may change or be cancelled.

10. Donations, Membership and Shop Purchases

Donations, membership fees, and merchandise purchases are processed securely by Stripe. We do not store your card details. By making a payment, you also agree to Stripe's terms.

  • Donations to Co-Exist as a registered charity are voluntary and, unless required by law, are generally non-refundable. If you believe a donation was made in error, contact us and we will consider your request in good faith.
  • Recurring donations and memberships continue until you cancel them. You can cancel at any time in your account settings or by contacting us; cancellation takes effect from the next billing cycle and does not refund amounts already charged for the current period.
  • Merchandise is sold subject to availability and the pricing shown at checkout. Your rights in relation to faulty or misdescribed goods under the Australian Consumer Law are not affected. Returns and refunds are handled in accordance with the returns process available in the app.

You confirm that any payment method you use is your own or that you are authorised to use it, and that the information you provide is accurate.

11. Third-Party Services

The Service relies on and may link to third-party services (for example Stripe, Supabase, Apple, and Google). We are not responsible for the content, practices, or availability of third-party services, and your use of them is governed by their own terms and policies.

12. Privacy and Your Data

Our handling of your personal information is described in our Privacy Policy. In line with the Australian Privacy Principles, you can access, export, correct, and delete your personal information. You can download a complete copy of your data and request account deletion at any time from Settings, under Data and Privacy, within the app.

13. Disclaimers and Consumer Guarantees

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, representations, and guarantees that are not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded (Non-Excludable Rights). Where our liability for a failure to comply with a Non-Excludable Right can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

14. Limitation of Liability

To the maximum extent permitted by law, and subject to your Non-Excludable Rights, Co-Exist and its directors, officers, employees, and volunteers are not liable to you for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, goodwill, or opportunity, arising out of or in connection with the Service or these Terms, whether in contract, negligence, or otherwise.

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the Service or these Terms is limited to the greater of the total amount you paid us (if any) in the twelve months before the event giving rise to the liability, or AUD 100.

15. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Co-Exist and its directors, officers, employees, and volunteers against any claims, liabilities, losses, damages, and reasonable costs (including legal costs) arising out of or in connection with your breach of these Terms, your User Content, your misuse of the Service, or your breach of any law or the rights of any other person. This clause does not apply to the extent a loss is caused by our own negligence or breach.

16. Suspension and Termination

You may stop using the Service and delete your account at any time from Settings within the app. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we reasonably believe your conduct puts others or the Service at risk, or if we are required to do so by law. On termination, the licence granted to you ends and you must stop using the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) survive.

17. Changes to These Terms or the Service

We may update these Terms from time to time. Where changes are material, we will notify you by email or an in-app notice. The date at the bottom of this page shows when these Terms were last updated. Your continued use of the Service after changes take effect means you accept the updated Terms. We may also change, suspend, or discontinue any part of the Service at any time.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Queensland, Australia. You and Co-Exist submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.

19. Dispute Resolution

If you have a concern or dispute, please contact us first at hello@coexistaus.org so we can try to resolve it directly. If we cannot resolve the matter within a reasonable time, either party may pursue the dispute through the courts referred to above. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief. This clause does not limit any rights you have to complain to a regulator, including the Office of the Australian Information Commissioner.
